But what happens if the mailing address you have for a contact isn’t in the US? How does an international address affect your lien rights?
Very simply, zlien’s platform is designed to mail documents within the United States—and for an important reason. We’ve written quite a bit about how zlien ensures your documents are compliant with state lien statue, which includes requirements for how they’re mailed. Often this involves sending documents via USPS Certified Mail, Certified Mail with Return Receipt, or even Certified Mail with Return Receipt Restricted Delivery. Since these types of mailings are products of the United States Postal Service, they are not supported internationally.
Why Does This Matter?
Let’s say you’re a subcontractor working on a job. You have the project address and an address for the general contractor, but the address you have for the property owner is in Canada. This means that if you were to mail your preliminary notice north of the border via Certified Mail with Return Receipt, tracking information and delivery confirmation would not be available. Even if you have to prove only that the mail piece was sent according to state requirements, having access to this tracking information is all-important.
So What Are Your Options?
If you find yourself in this situation, zlien’s recommended best practice is to search for a US address to the best extent possible. If the company is doing business in the United States, chances are they’ll have an address in the country that can be found through the secretary of state’s website. This way, specific requirements for mail type (if any) can be met when your document is sent.
